Prelude Detect AI User Guidelines

These Prelude Detect AI User Guidelines (“Guidelines”) govern your use of Prelude Detect’s generative AI features. In addition, your use of these features is governed by the Master Services Agreement under which you purchased the services (the “Services Agreement”).

You hereby agree that these Guidelines will form a part of and supplement the Services Agreement. In case of conflict between these Guidelines and the Services Agreement, these Guidelines shall take precedence.

The Prelude Detect’s generative AI features are based on the generative AI solutions provided by OpenAI OpCo, LLC. As a result, your use of these features may be subject to OpenAI’s policies. For more information, please visit https://openai.com/policies.

1. Generative AI is not foolproof.  Please review and validate any tests or detections on non-production machines prior to deployment.

AI-generated Prelude threats offer a promising avenue for identifying vulnerabilities and gaps in visibility. However, it's imperative to recognize that these AI-generated tests are not foolproof and may not capture all possible attack vectors or vulnerabilities. As such, human review and testing remain essential components of the security validation process.

Prelude strongly recommends source code review of all AI-generated security tests and the associated detections before the tests are run on any systems. All tests should be further validated on non-production systems before they are fully deployed.

You are solely responsible for all use of the generated outputs and evaluating them for accuracy. You also agree that the outputs you create may not be original and other users may generate outputs that are similar or identical.

2. Please respect third party copyrights.

Using Prelude Detect’s generative AI features to create, upload, or share content that violates third-party copyright, trademark, privacy, publicity, or other rights is prohibited, including uploading an input that includes a third party’s copyrighted content. If you’re not sure whether your content violates the rights of a third party, you may want to reach out to an attorney for guidance.

By using our Prelude Detect’s generative AI features you warrant that you have the full legal right, authority, and permission to use and upload any documents to the Detect platform (“inputs”). You further warrant that your inputs and their submission do not infringe upon any third-party rights, or violate any applicable laws, regulations, or policies, including those related to data protection, privacy or confidentiality, and you hereby agree to indemnify Prelude against any claims, damages, losses, liabilities, or expenses arising from the document’s upload or use.

You hereby grant us a fully paid, royalty-free, irrevocable, worldwide, non-exclusive license to use your inputs to provide the generative AI features. You retain full ownership of your inputs. Prelude will not use your inputs or generated outputs to train or improve its generative AI features without your explicit consent.

Generated Outputs Ownership: Prelude hereby grants you a non-exclusive, non-transferable, revocable, fully paid, royalty-free and worldwide license to use the outputs generated by Prelude Detect’s generative AI features solely for use in conjunction with your Prelude Detect subscription and for your internal business purposes, subject to the terms and conditions of these Guidelines and any other applicable agreements between you and Prelude.

You may not represent or imply that the generated outputs were created by a human or that it is original content. You must clearly indicate that the outputs were generated by AI. You may not use the outputs generated by Prelude Detect’s generative AI features for any commercial purposes, including but not limited to, selling, licensing, or distributing the output to third parties. You may not publish or publicly display the output or incorporate it into any work that is made available to the public, without the prior written consent of Prelude.

If you want to report the misuse of your own intellectual property by one of our users, you can do that by sending an email to legal@preludesecurity.com. If you have a contract or other dispute with a Prelude Detect user regarding inputs they have uploaded to our products and services, please resolve the issue directly with the user. We will not moderate disputes between our users and the public.

3. Please do not include personal data in your inputs.

If possible, please ensure that any inputs you upload to Prelude Detect’s generative AI features do not include personal data or information within the meaning of applicable data protection laws. Inputs should be de-personalized, anonymized, or otherwise encrypted.

If you include personal data in your inputs nonetheless, you agree that their processing will be governed by the Data Processing Agreement which forms part of the Master Services Agreement under which you purchased Prelude’s services.

4. Please do not use our services to generate harmful or illegal content.

You may not use the Prelude Detect’s generative AI features for any illegal or unauthorized purpose, or to generate content that is harmful, offensive, dangerous, or otherwise objectionable. This includes circumventing the security restrictions implemented in our or third-party AI features.

You are solely responsible for any misuse of Prelude Detect’s generative AI features and for any consequences that may result from such misuse. Prelude disclaims any liability for any damages or losses arising from your use of the AI features in violation of these Guidelines or any applicable laws or regulations.

5. Disclaimers.

As stated above, the Prelude Detect’s generative AI features use third-party generative AI solutions, i.e., automated tools that provide information or generate text, code, etc. based on their programming and training data. You acknowledge that any output you generate by using such third-party AI solutions: (i) may contain incorrect elements; (ii) is based on the data and programming used to train the model; this means that Prelude assumes no liability for any output generated by such third-party AI solutions.

EXCEPT AS EXPRESSLY PROVIDED HEREIN AND TO THE EXTENT PERMITTED BY APPLICABLE LAW, THE PRELUDE GENERATIVE AI FEATURES AND ANY GUIDANCE OR RECOMMENDATIONS THEREIN ARE PROVIDED "AS IS" AND PRELUDE DOES NOT MAKE WARRANTIES OF ANY KIND, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING THOSE OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT OR ANY REPRESENTATIONS REGARDING AVAILABILITY, RELIABILITY, OR ACCURACY OF THE PRELUDE GENERATIVE AI FEATURES.

6. Limitation of Liability

Prelude’s liability is subject to limitations and exclusions set forth in the Services Agreement. In case you did not enter into the Services Agreement with Prelude, you agree to the following.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WHATEVER THE LEGAL BASIS FOR THE CLAIM, PRELUDE WILL NOT BE LIABLE FOR ANY INDIRECT DAMAGES (INCLUDING, WITHOUT LIMITATION, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND WHATSOEVER (INCLUDING, WITHOUT LIMITATION, ATTORNEYS’ FEES), DAMAGES FOR LOST PROFITS OR REVENUES, BUSINESS INTERRUPTION, OR LOSS OF BUSINESS INFORMATION) DUE TO, RESULTING FROM, OR ARISING IN CONNECTION WITH YOUR USE OF THE PRELUDE DETECT’S GENERATIVE AI FEATURES.

To the extent permitted by applicable law, whatever the legal basis for the claim, Prelude’s aggregate liability for any direct damages incurred by you in connection with your use of the generative AI features, shall not exceed the amount of service fees paid or payable by you to Prelude for the 12 months preceding the filing of the claim (or over the first 12 months if such incident arises during the first 12 months).

7. Final Provisions  

Prelude reserves the right to suspend or terminate your access to the Prelude Detect’s generative AI features if you violate these Guidelines.

These Guidelines may be updated from time to time at Prelude's sole discretion. Continued use of Prelude Detect’s generative AI features after any such changes constitutes your acceptance of the new Guidelines. It is your responsibility to regularly check the Guidelines to determine if there have been changes and to review such changes.

If you encounter any issues or have concerns with the AI-generated outputs or the service itself, please contact Prelude's support team for assistance. You can reach us by emailing support@preludesecurity.com. When reporting an issue, please provide as much information as possible, including a description of the issue, any error messages or screenshots, and the steps you took leading up to the issue. Our support team will respond to your inquiry as soon as possible and work with you to resolve the issue.
